1. About Us

Decant is an independent fragrance decanting studio based in the United Arab Emirates. We operate as part of Planerin FZC, a company registered in the Sharjah Free Zone, UAE.

We curate and decant authentic fragrances from verified sources into smaller premium glass atomizers, making fragrance more accessible to our customers.

2. Eligibility

By using the Site or placing an order, you confirm that:

- You are at least 18 years old, or you have the consent of a parent or legal guardian

- You are accessing the Site from a region where its use is legal

- The information you provide during checkout is accurate, current, and complete

- You are using the Site for lawful purposes only

We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion if these conditions are not met.

3. Products and Services

Authenticity: Every fragrance we sell is sourced from authentic, original bottles purchased through verified distributors or retailers. 

Decanting: Our products are decanted from original brand bottles into Decant-branded premium glass atomizers. The fragrance inside remains unchanged, undiluted, and unaltered.

Brand Affiliations: Decant is not affiliated with, sponsored by, endorsed by, or in partnership with any of the fragrance brands whose products we decant. All brand names, logos, and trademarks shown on our Site are the property of their respective owners and are used for identification purposes only.

Product Descriptions: We make every effort to display accurate descriptions, photographs, and information about our products. However, slight variations in color, packaging, or scent perception may occur, and we do not guarantee that descriptions are completely error-free.

Availability: All products are subject to availability. We reserve the right to limit quantities, modify products, or discontinue items at any time without prior notice.

4. Pricing and Payment

Currency: All prices are listed in UAE Dirhams (AED) and are inclusive of UAE VAT (5%) where applicable.

Price Changes: Prices are subject to change without notice. The price displayed at the time of checkout is the price you will be charged.

Payment Methods: We accept payment via major credit and debit cards, Apple Pay, where available.

Payment Authorization: By placing an order, you authorize us to charge the payment method provided for the total amount of your order, including any applicable taxes and shipping fees.

Failed Payments: If a payment fails or is declined, your order will not be processed. We are not responsible for delays caused by payment issues.

5. Orders and Acceptance

When you place an order on Decant, you are making an offer to purchase. Your order is not confirmed until you receive an order confirmation email from us.

We reserve the right to:

- Refuse, cancel, or limit any order at our sole discretion

- Cancel orders that appear fraudulent or violate these Terms

- Cancel orders if the product is out of stock, mispriced, or otherwise unavailable

- Cancel orders shipping to regions we do not currently serve

If we cancel an order after payment has been processed, a full refund will be issued to the original payment method.

6. Shipping and Delivery

We currently ship within the United Arab Emirates only. International shipping is not yet available.

Dispatch and Delivery Times: UAE orders are dispatched within 24 hours of purchase and typically arrive within 1 to 4 business days. Delivery times are estimates and not guaranteed.

Shipping Fees: Free shipping is available on UAE orders above AED 199. Orders below this threshold are subject to a flat-rate shipping fee, calculated at checkout.

Delivery Risk: Risk of loss and title for products passes to you upon delivery to the carrier. Once your order is handed over to our courier partner, we are not liable for delays caused by external factors, including weather, customs, or courier service issues.

7. Returns, Refunds, and Damaged Orders

Due to the personal nature of fragrance, opened decants cannot be returned, exchanged, or refunded. However, we will replace or refund orders that arrive damaged, leaking, incorrect, or undelivered.

8. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You agree NOT to:

- Use the Site for any fraudulent or illegal activity

- Attempt to gain unauthorized access to the Site, our servers, or any related systems

- Use automated tools (bots, scrapers, crawlers) to extract data from the Site without permission

- Upload or transmit viruses, malware, or any harmful code

- Interfere with or disrupt the operation of the Site

- Misrepresent your identity or affiliation when communicating with us

- Use the Site in any manner that could damage, disable, or impair the Site

We reserve the right to terminate access for any user who violates these conditions.

9. User Accounts

You may create an account to manage orders and track purchases. If you create an account, you are responsible for:

- Providing accurate and up-to-date information

- Maintaining the confidentiality of your account credentials

- All activity that occurs under your account

- Notifying us immediately of any unauthorized account access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

10. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, photographs, product imagery, descriptions, and design elements, is the property of Decant or used with permission, and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or use any content from the Site for commercial purposes without our prior written consent.

The "Decant" name and brand identity are the property of Planerin FZC. Third-party fragrance brand names and logos shown on the Site are the property of their respective owners.

11. User-Generated Content

If you submit reviews, comments, photos, or any other content to the Site or to our social media channels, you grant Decant a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display that content in connection with our marketing, advertising, and Site operations.

You are responsible for ensuring that any content you submit:

- Does not infringe on the rights of any third party

- Is not defamatory, offensive, or unlawful

- Is your original work, or do you have permission to share it

We reserve the right to remove any user-generated content at our discretion.

12. Privacy

Your privacy is important to us. We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

13. Promotional Codes and Offers

From time to time, we may offer discount codes, promotional offers, or sales. These offers:

- Are subject to specific terms and conditions stated at the time of the promotion

- Cannot be combined with other offers unless explicitly stated

- May be withdrawn or modified at any time without prior notice

- Are not transferable or redeemable for cash

- May be limited to one use per customer

We reserve the right to cancel orders where promotional codes are misused or applied fraudulently.

14. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Decant makes no warranties, express or implied, regarding:

- The accuracy, reliability, or completeness of information on the Site

- The uninterrupted or error-free operation of the Site

- The suitability of any product for a particular purpose

Fragrance is a personal experience, and we cannot guarantee that any product will smell the same on your skin as it does on others or as described.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Decant, Planerin FZC, and our officers, employees, and partners shall not be liable for:

- Any indirect, incidental, special, consequential, or punitive damages

- Any loss of profits, data, or business opportunities

- Any damages arising from your use of, or inability to use, the Site or our products

Our total liability for any claim arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid for the specific order giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless Decant and Planerin FZC from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

- Your use of the Site or our products

- Your violation of these Terms

- Your violation of any rights of a third party

- Any content you submit to the Site

17. Force Majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, civil unrest, pandemics, courier failures, supply chain disruptions, or technical failures.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from or related to these Terms or your use of the Site shall be resolved exclusively in the courts of Sharjah, UAE.

If you are accessing the Site from outside the UAE, you are responsible for compliance with the laws of your jurisdiction.

19. Modifications to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The most current version will always be available on our website with the "Last updated" date at the top.

Your continued use of the Site after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with one that most closely reflects the original intent.

21. Entire Agreement

These Terms, together with our Return and Refund Policy, Privacy Policy, and Shipping Policy, constitute the entire agreement between you and Decant regarding your use of the Site and supersede any prior agreements.
